Freeosk, Inc. ("Freeosk", "we" or "our") helps connect consumers with producers of products and vice versa, with no pressure, no obligation and no cost. In this way you can consider and try free samples of products that you might be interested in trying or buying.
This Privacy Policy applies to the websites and mobile applications and other interactive features and online services, owned or operated by Freeosk that post a link to or include this Privacy Policy (collectively, the "Services"). This Privacy Policy describes our information and privacy practices with regard to the Services and information we collect offline, which we may combine with online data.
By using the Services, you agree to the collection, disclosure, and use of your information as described in this Privacy Policy. If you do not agree with the terms of this Privacy Policy and applicable Terms of Use, do not access or use the services or provide personal information to us.

Overview
You can review certain limited information about us and our Services on our web site and any Freeosk kiosk without telling us who you are. However, to obtain a sample or receive information from us you will need to do one of two things: 1) You can sign up for an account and become a Freeosk Member through participating Freeosk locations, our mobile app or web site; or 2) you can use certain existing credentials you use with a participating store. For example, a designated club, loyalty, credit or other store card; email address; phone number; or other credentials associated with a retailer ("Retailer Credentials") to access the Service at designated Freeosk locations. Once you use your Retailer Credentials to access the Services, your information will be shared with us and you will also become a Freeosk Member.
Note that anytime you choose to connect your use of the Freeosk Services to Retailer Credentials, information about you will be shared between us and the applicable retailer, including personal information, information relating to your purchases and samples tried, and information related to your interests and preferences. If you become a Freeosk Member or provide us with your email address or other information through any of our Services (including by using Retailer Credentials), you consent to our processing, storage and transfer of that information, as described in this Privacy Policy.
1. Personal, Sensitive, and Non-Personal Data We Collect and How We Use and Disclose It
We may collect data from you directly, automatically when you visit the Services, and sometimes from third parties. Some of this data may be considered "personal information" or "personal data," and some of which may be considered "sensitive" under various applicable laws. We consider information that identifies you as a specific, identified individual to be personal information (such as your name, phone number, e-mail address), and we treat additional information, including IP addresses and cookie identifiers, as "personal data" where required by applicable law. 2. Additional Details About Our Data Practices
We provide in this section additional detail about the data practices listed in the chart above, where it would be helpful for your understanding of such practices.

Data We Collect Automatically: Device ID/Interaction Information. We and our third party business partners (including third-party content, advertising, and analytics companies and other third party service providers) may use a variety of technologies, including cookies and web beacons, that automatically or passively collect certain information whenever you visit or interact with the Services ("Device ID/Interaction Information"), which we store in our server log files and which we may associate with your Freeosk profile. Device ID/Interaction Information may include information such as your web request, browser type, the operating system you are using, the URL or advertisement that referred you to our Services, the search terms you entered into a search engine that lead you to one of our Services, how you interact with the Services, your mobile carrier, and the time of day you visited the Services, among other information. It also includes how you use our Services, such as product samples you have viewed, selected and reviewed, and coupons or other offers you have requested, received and used.
Device ID/Interaction Information also includes your IP address, mobile device identifiers, and other unique identifiers associated with the device you use to access our Services. Device ID/Interaction Information uniquely identify your device and may be data stored in connection with the device hardware, data stored in connection with the device's operating system or other software, or data sent by us to the device. Device ID/Interaction Information may be used to recognize you and track how you use the Services. We may combine Device ID/Interaction Information with personal information we have collected and may store Device ID/Interaction Information in your profile.
Geo-Location Data. We may infer your general location using other information we collect, such as IP address. In addition, when you opt-in to collection of location data through mobile application(s) (each an "App") you use to interact with us, we may access, collect, monitor and/or remotely store specific "location data" from your device, which may include GPS coordinates (e.g. latitude and/or longitude) or similar information regarding the location of your device. And, of course, whenever you interact with one of our Freeosks, we will know the store and location of that Freeosk. Geo-location and more general location data may be used to provide you with information, such as enabling you to find our Freeosk kiosk locations, or to send you special offers based on your location. You may be able to turn off the collection of location information through your device settings. However, please note that we may still be able to infer your approximate location through other information we collect, such as IP address. In addition, some mobile service providers may also provide us or our third-party service providers with information regarding the physical location of the device used to access the Services.
Some features of the Services, particularly location-based offers, may not function properly if use or availability of location data is impaired or disabled.
We use the following types of tracking technologies to collect Device ID/Interaction Information:
Cookies and Local Storage. We may send one or more "cookies" to uniquely identify your browser, which are small data files placed on your computer or other device when you access our Services or online content. Cookies may be used for many purposes, including to provide us information about how you utilize the Services, remember you and your preferences, save your information to log-in faster, track your visits to our webpages, and otherwise enhance your navigation through the Services. We may use cookies to assist us in targeting information, advertising, or other communications to you.
We use both session and persistent cookies. A session cookie is temporary and disappears when the Service session is completed. You can reset your web browser on your computer or mobile device to refuse all cookies or to indicate when a cookie is being sent. A persistent cookie remains on the hard drive of your device after you close your browser so that your browser can use it on subsequent uses of the Services accessed by that device. Pixel Tags. Small graphic images or other web programming code (also known as web beacons or 1x1 GIFs or clear GIFs) may be included in our web pages and email messages. These and similar technologies may be used for a number of purposes by us and third parties, including to count visitors to the Services, to monitor how users navigate the Services, to count how many emails that were sent were actually opened or to count how many particular videos or links were actually viewed, or for marketing and targeted advertising purposes.
In addition, we may use these and a variety of other technologies that collect Device ID/Interaction Information and similar information for security and fraud detection purposes.
Embedded Scripts. An embedded script is programming code that is designed to collect data about your interactions with the Services, such as the links you click on. The code is temporarily used by our server or a third party service provider or business partner while you browse or interact with the Services and is deactivated or deleted when you disconnect from the Services.
Data Collected Through Mobile Devices and SDKs. We use embedded scripts and the tools provided in Software Development Kits ("SDKs") to collect data through mobile devices such as the hardware model, operating system and version, identification numbers assigned to your mobile device, such as the ID for Advertising (IDFA) on Apple devices, and the Advertising ID on Android devices, mobile network data, and website usage behavior. SDKs are software packages that contain a set of tools that can be used to help build applications and implement new features in existing apps including those that collect data from your device.
In addition, we may use these and a variety of other technologies that collect Device ID/Interaction Information and similar information for security, fraud detection, and maintenance purposes.

Data We Receive or Collect from Third Parties.
Data Provided to Us by Retailers. Sometimes you will use Retailer Credentials issued by or associated with the store where you are shopping or the store's app to access our Services. If you use Retailer Credentials or a store related app to interact with a Freeosk kiosk, you will establish a separate profile with us that is separate from that retailer ("Freeosk Member Profile"). We refer to the applicable store as the "Retailer". The Retailer will be able to identify that you used a Freeosk kiosk, and may share certain information with us about you and your purchase and transaction history, as well as your first and last name, contact information, your customer ID associated with the Retailer or other identifier (which may include a mobile advertising ID), and other information the Retailer has collected about you.
When you associate your use of our Services with Retailer Credentials or retail app, we and the Retailer may exchange and share data regarding your use of the Services including the samples you try, your purchase history with the retailer and other information in your profile. You can confirm what information is shared between the Retailer and Freeosk by contacting the Retailer or contacting us using our contact information below. For more information, please see our chart of disclosures.
Enhancement Data. In addition, we may receive information about you from other third parties. For example, we may supplement the information we collect with outside records from third parties, such as public databases, publicly available social media pages, or joint marketing partners, for various purposes, such as to provide you with information, services or products, to tailor our content and the offers we show you, or to enhance our products and services.
We may combine information we receive from third parties with information we collect through the Services. In those cases, we will apply this Privacy Policy to the combined information.

Data You Provide Directly. We may ask you to provide us information directly, such as contact information, including your name, mailing address, and email address, and other information about you, such as demographic information (for example, ZIP code and day and month of birth) and information about your interests and preferences. When you create an account, it may include username and password. You may provide personal information and other information through various forms and features on the Services.
Sweepstakes, Contests, and Promotions. We may offer sweepstakes, contests, or other promotions (any, a "Promotion") that may require registration. By participating in a Promotion, you agree to the conditions or official rules that govern the Promotion, which may involve specific requirements (including allowing the sponsor(s) of the Promotion to use your name, voice, likeness, or other indicia of persona in advertising or marketing materials, except where prohibited by law). If you choose to enter a Promotion, personal information may be disclosed to third parties or the public in connection with administering the Promotion, such as in connection with winner selection, prize fulfillment, as required by law, or as permitted by the Promotion's terms or official rules.
Resume Submissions. You may submit your resume and personal information through the website in response to (or to be considered for) a potential job opening at Freeosk. When you apply for a job with Freeosk, we may ask you to provide self-identifying information (such as veteran status, gender, and ethnicity) in conjunction with laws and regulations enforced by the Equal Employment Opportunity Commission and other federal, state, and local regulatory agencies. Providing such self-identifying information is voluntary, but if you do provide such information, we and/or our service provider may submit that information to the appropriate government or regulatory agencies to fulfill reporting requirements and use that information to defend against employment-related complaints.

Disclosure of Data to Third Parties. Freeosk may share non-personal data, such as Device ID/Interaction Information, aggregated user statistics, and information that has been hashed or otherwise de-identified or pseudonymized data (including email addresses), and/or our analyses derived from such data, with third parties in our discretion, including for targeted advertising purposes. Please note that we are not responsible for the privacy practices of any third party. If you decide that you do not want to receive communications from a third party, or have questions about their privacy practices, you will need to contact that third party directly. Freeosk may share data we have collected about you (including personal data) as disclosed at the time you provide your information, as described in this Privacy Policy, with your consent, and in the circumstances described below.
Information Shared through Our Partnerships with Retailers. When you interact with us using Retailer Credentials or a retailer's app, the Retailers may share certain information about you with us (as described above) and we may also share certain information with the Retailer. The information we share with the Retailer may include your personal data, which the Retailer may use for the purposes of directly sending you communications and promotional materials regarding their goods and/or services, directly, or through the Services. It also includes information regarding the samples you have tried, coupons you have used, and other information relating to your use of the Services. Please see our U.S. State Specific Rights section for additional information. California residents, please see "Notice to California Residents" for additional information.
Service Providers. We may provide information about you with third-party service providers to enable them to perform services on our (or your) behalf. These third parties may include computer hosting services, data matching services, and email or mobile communication companies.
Social Media Interactions. We may host or facilitate interactions with social media or other third party platforms, like Facebook, Instagram, or X (Twitter). You may also have the opportunity to log in through or otherwise connect your third party platform account. When you interact with these third party platforms through the Services, we will receive data about you from the third party platform service and you will be choosing to share data about your interactions with Freeosk with that social media service.
In addition, the third party platform service may set their own cookies and collect data about your use of the Services, including your IP address or other device identifiers, and which pages you visit on the Services. These third party platforms may be able to collect certain data on your visits to the Services regardless of whether or not you affirmatively interact with the feature and whether or not you are logged into (or have) an account with the third party platform. If you are logged out or do not have an account and visit a page with a social plug-in, your browser sends a more limited set of data. Like other sites, the third party platform will receive data about the webpage you are visiting, the date and time of your visit, and other browser-related data. They may use that data to help them improve their products or for other purposes set forth in their privacy policy. We may also receive data about you if other users of social media give us access to their profiles and you are one of their connections or "friends."
The data we collect is subject to this Privacy Policy. The data collected and stored by the third party remains subject to the third party's privacy practices, including, without limitation, whether the third party continues to share data with us, the types of data shared, and your choices with regard to what is visible to others on that third-party website or service. The third party may allow you to remove the application or feature, in which case we will no longer collect data about you through the application or feature, but we may retain the data previously collected.
If you choose to post information to a third-party platform, that information may be public.
Business Transitions. In the event Freeosk goes through a transition such as being sold, has all or a portion of its assets acquired or transferred, whether voluntary or involuntary (such as through bankruptcy), or merges or becomes affiliated with any other division, individual, or entity (such as during the course of any due diligence process), any customer data owned or under the control of Freeosk (including your personal information) will likely be one of the transferred assets. We reserve the right, as part of this type of transaction, to assign or otherwise transfer your data (including your personal data) and other data we have collected from users of the Services. By providing your personal data, you agree that we may transfer such data to the acquiring entity without your further consent.
Administrative and Legal Reasons. Freeosk may transfer and disclose data, including your personal data, Device ID/Interaction Information with third parties if required to do so by law or subpoena or if we believe that it is reasonably necessary to comply with a law, regulation or legal process; to address fraud, security or technical issues; to protect our rights, property, safety, security, or that of other users or the public. We may in our sole discretion elect in good faith to cooperate with copyright owners, Internet service providers, wireless service providers or any law enforcement agency requesting assistance with an official investigation by disclosing and/or sharing with such agency any and all information, data and/or content connected with you and/or your use of the Services. We may also, but need not, in our sole discretion, initiate a report to any law enforcement agency where it is reasonably suspected that unlawful activity may occur, or may have occurred, including sharing data connected with you and/or the Services.
When You Direct that We Share Your Data. We may share data when you direct that we do so. For example, you may be presented with an opportunity to receive information and/or marketing offers from one or more third parties. If you agree at that time to have your personal data shared, your personal data will be disclosed to that third party (or parties) and will be subject to their privacy practices. Or you may choose to interact with a third party application or feature, through which data about you is shared. Please note that we are not responsible for the privacy practices of third parties. If you later decide that you no longer want to receive communications from a third party, you will need to contact that third party directly.
3. Third Party Advertising and Analytics Companies and Similar Third Parties/Privacy Controls
Freeosk works with third party business partners, such as analytics companies, network advertisers, ad agencies, and other advertising partners who provide us with data about the Services, users, and our advertisements, and who serve Freeosk ads to you on our behalf online and through our Services. We and our third party business partners collect certain data about your visits to and activity on the Services and other websites and services, including through the Social Media Features. We may use data we have learned about you to target ads to you and to allow third parties, such as the companies that provide the products you sample, to target ads to you. We may also use analytics providers to provide us with information regarding the use of the Freeosk Services and the effectiveness of our advertisements. We may also share (or permit third parties to collect) certain data, such as Device ID/Interaction Information, aggregated or de-identified, pseudonymized or hashed data (including email addresses), with these third parties for similar purposes.
These third parties may set and access their own tracking technologies on your device (including cookies, pixel tags, or other technology), and they may otherwise collect or have access to information about you, some of which may be personal data under various state laws. And, we our third party advertising and analytics providers may collect personal data over time when you visit the Services or other online websites and services.
We may share non-personal data, including data that has been hashed or otherwise de-identified, aggregated user statistics, and Device ID/Interaction Information, directly or indirectly through third party service providers, with third party advertising companies, analytics providers, and other third parties, including for the purpose of serving you more relevant ads.
In addition, we may share personal data with third parties who combine and link information from Freeosk with data from other sources. These third parties may then make non-personal data available to third-party advertisers, including information about your interests and preferences, to enable them to serve you more relevant ads. See the "Your Choices" section for information on how you may opt-out from our sharing your personal data with these advertising related third parties.
- Cookie Opt-Out Tool. To disable sharing through cookies set on our site by third parties for advertising and analytics purposes, please visit the website footer to change your preferences.
- NAI/DAA Opt-Out. Some of the third party advertising and analytics providers we use are members of the Network Advertising Initiative ("NAI") or the Digital Advertising Alliance ("DAA") Self-Regulatory Program for Online Behavioral Advertising. The NAI provides information regarding targeted advertising and opt-out procedures of NAI members, including opt-out mechanisms for web browsers, mobile and other connected devices, and a tool to opt out from participating NAI members using your hashed email address for internet-based advertising. - Google Analytics. One analytics provider with whom we work is Google Analytics. Google Analytics uses cookies and similar technologies to collect and analyze data about the use of the Services and report on activities and trends. This service may also collect data regarding the use of other websites, apps, and online resources. You can learn about Google's practices by going to https://policies.google.com/technologies/partner-sites and opt out of them by downloading the Google Analytics opt-out browser add-on, available at https://tools.google.com/dlpage/gaoptout.
- Mobile Device/AppChoices. For mobile applications, you may be able to limit certain advertising practices using the settings on your phone, tablet, or other mobile device. Also, on most mobile devices, you can install the DAA's AppChoices app to make choices about cross-app interest-based advertisements from participating third parties.
Please note that opting out through these mechanisms does not opt you out of being served advertising. You will continue to receive generic ads while online. Your opt-out choices are browser and device specific; if you disable your cookies, upgrade your browser after opting out or if you use multiple different devices, please opt-out on each device and each browser separately.
4. Your Choices
Marketing Messages from Us. You may opt-out of marketing communications as set forth below.
- Emails. You may opt out of receiving email communications that are strictly promotional by unchecking the registration box or following the opt-out language contained in any promotional email. Please note that we reserve the right to send you certain communications relating to your account or use of the Services (for example, responses to communications we receive from you or updates to our policies) and these transactional account messages may be unaffected if you opt-out from marketing communications.
- Text Messages. If you provide us with your mobile number and sign up to receive SMS, MMS, or RCS messages from us, your wireless carrier may impose a charge on incoming texts. Please check with your wireless carrier for details. You may opt-out of text messages sent by Freeosk by replying "STOP" to any text message we send to you.
- Push Notifications. We may send promotional and non-promotional push notifications or alerts to your mobile device, and may in some cases do so based on your device's location or physical proximity to a beacon. If you have opted in to receive push notifications from our mobile application(s), you can turn off push notifications in your device settings. You can also turn off our collection of GPS location data on your device through your device settings.
Data Privacy Choices.
- Opt-Out of Targeted Advertising. If you do not want us to share your email address, or other personal information we have associated with your email address, with third party advertising-related companies in order to market and advertise to you online based on your interests and preferences, and to perform related services such as measurement and analytics, please visit https://www.thefreeosk.com and click the Opt Out of Targeted Advertising link in the footer.
- Access, Correction and Deletion. You are responsible for maintaining the accuracy of the data you submit to us, such as your contact data. Freeosk will make good faith efforts to make requested changes in our then active databases as soon as reasonably practicable. Note, however, that data may persist internally for administrative purposes and that residual data may remain on backup media or for other reasons. If you would like to access, correct, amend or delete personal data collected by Freeosk through the Services, you may do so by email to: privacy@thefreeosk.com. Certain jurisdictions provide additional privacy rights, please see more in the U.S. State-Specific Rights section, below.
5. Security
Information received by us through the Service is stored and processed on secured servers and computers we control in the U.S. We use commercially reasonable technical and administrative security measures designed to reduce the risks of loss, misuse, unauthorized access, disclosure and alteration of your personal information. Some of the safeguards we use are firewalls, data encryption, physical access controls to data centers, and information access authorization controls. While we have implemented reasonable security measures please keep in mind that "perfect security" does not exist, and no transmission of information over the Internet or your mobile device is guaranteed to be completely secure. For example, unauthorized entry or use, hardware or software failure, and other factors may compromise data security. We cannot warrant or ensure the security of any information we collect. You acknowledge and agree to assume this risk when communicating with us and utilizing the Service.
Please remember that you are responsible for maintaining the confidentiality and security of any member name and password you use in connection with the Services. If you believe that your account information is being used in an unauthorized fashion, you must contact us immediately. You are also responsible for all use of the Service resulting from your Retailer Credentials, password, user id.
6. Third Party Links & Content
The Services may link to or incorporate websites or content hosted and served by third parties over which we have no control, and which are governed by the privacy policies and business practices of those third parties. The third-party operators and content providers use their own cookies or other tracking technologies, and they may independently collect data from or about you. Freeosk is not responsible for the privacy practices or business practices of any third party.
7. International Users; Consent to Transfer
Freeosk is a United States company. If you are located outside of the United States, you acknowledge that the data we collect will be transferred to and processed in the United States. If you are located in the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that you are transferring data, including personal data, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction. By using the Services, or providing us with any data, you fully understand and unambiguously consent to the transfer to, and processing, usage, sharing, and storage of your data in the United States and other jurisdictions. As a result, this data may be subject to access requests from governments, courts, or law enforcement in accordance with the laws of that jurisdiction. Your data will also be disclosed to third parties as described in the Personal, Sensitive, and Non-Personal Data We Collect and How We Use and Disclose It section above.
8. General Audience Services
The Services are general audience and do not target users younger than 16 years of age. We do not knowingly collect or solicit personal information from anyone younger than the age of 16 or knowingly allow such persons to utilize the Services. Certain Retailers may impose additional age restrictions concerning the use of the Services. If we become aware that we have collected personal information from an individual under age 16 we will take steps to remove that information and terminate that membership/account. 9. Changes to the Privacy Policy
To the extent allowed by applicable law, Freeosk reserves the right to change or modify this Privacy Policy at our discretion at any time, and we will notify you of material changes by posting the changed or modified Privacy Policy on our site. We may also provide notice to you in other ways, such as through contact information we have about you. Changes to this Privacy Policy are effective immediately when they are posted unless another date is provided. Your continued use of the Services after the effective date of the revised Privacy Policy (or such other act as specified in the revised Privacy Policy) will, to the fullest extent permitted by applicable law, constitute your consent to those changes. However, we will provide notice and obtain your consent (opt-in or opt-out) if required by law. Note that you may need to consent to our new policies to continue using the Services.

11. Limitation of Liability
By providing us with any personal data you expressly and unconditionally release and hold us harmless from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the use and/or misuse of the data. In addition, while we take efforts to ensure the proper and appropriate use of data by our service providers and third parties (e.g. Retailers) that may receive your information from us, we cannot be liable for any injuries, loss or damage of any kind arising from or in connection with the use and/or misuse of your data caused by those service providers and third parties.
12. U.S. State-Specific Rights
Residents of certain U.S. states may have the ability to exercise additional rights and choices regarding their personal data. We will take reasonable steps to accommodate your request but may need to verify your identity before doing so. - Delete Your Personal Data (CO, CT, UT, VA Residents) - You have the Right to Delete your personal data.
- Correct Your Personal Data (CO, CT, VA Residents) - You have the Right to Correct the personal data we hold about you.
- Cookie-Based Opt-Outs for Targeted Advertising - Freeosk engages in online advertising practices (and certain analytics or similar activities) that may be considered "targeted advertising" under VA, CO, CT, and UT state laws. To disable sharing through cookies set by third parties that may be considered targeted advertising under such laws, adjust your cookie settings using the Cooking Settings link in the footer of www.thefreeosk.com. Please also review the Third-Party Advertising & Analytics section above for information on industry tools and device settings that may be available to you.
- Right to Appeal (CO, CT, VA Residents) - If, for any reason, you would like to appeal our decision relating to your request and you are a resident of Colorado, Connecticut, or Virginia, you have the right to submit an appeal and can do so by emailing: privacy@thefreeosk.com or calling 888-563-1121 Please include your full name, the basis for your appeal, and any additional information to consider.
- Sensitive Data - If you are a Virginia, Colorado, or Connecticut resident, we will obtain your consent to the processing of any Sensitive Data (as defined by the applicable state law) we collect. If you are a resident of Utah, we will notify you at or before the time of collection of Sensitive Data (as defined by Utah law).
- Opt-Out of Profiling in furtherance of legal or similarly significant effects (CO, CT, VA) - Freeosk does not process your personal data for the purposes of profiling in furtherance of decisions that produce legal or similarly significant effects as defined under the CPA, CTDPA, or VCDPA.
Nevada. Freeosk does not currently sell your covered information as those terms are defined under applicable Nevada law. However, you may still submit an opt-out request and we will honor that request as required by Nevada law if Freeosk were to ever engage in such a sale in the future. If you are a Nevada resident and would like to opt-out of future sales of your covered information, please visit https://www.thefreeosk.com and click the "Do Not Sell My Personal Information" link to opt-out. You may also be required to take reasonable steps as we determine from time to time in order to verify your identity and/or the authenticity of the request. Freeosk will respond to your request within sixty (60) days either confirming that your request has been processed or indicating that we need an additional thirty (30) days to complete the request.
13. Notice to California Residents
This California Privacy Notice is effective as of: November 1, 2024.
This notice supplements Freeosk's Privacy Policy and applies only to California residents. This California Privacy Notice sets forth disclosures and rights for California Consumers regarding their Personal Information, as required by the California Consumer Privacy Act of 2018 ("CCPA"), the California Privacy Rights Act of 2020 ("CPRA"), and any implementing regulations adopted thereunder. Terms (including defined capitalized terms) used in this California Privacy Notice have the same meanings given in the CCPA, CPRA, and the associated regulations, unless otherwise defined.
Exercising Your California Rights
California Consumers have the right to request: (1) that we disclose to you what personal information we collect, use, disclose, and sell/share, including the right to request that we provide to you the specific pieces of personal information we have collected about you ("Right to Know"); (2) that we delete the personal information we have collected about you ("Right to Delete"); (3) that we correct inaccurate personal information we hold about you ("Right to Correct"); (4) to opt out from the sharing of your personal information and sensitive personal information to a third party for cross-context behavioral advertising (i.e., targeted advertising) ("Right to Opt-Out of Sharing"); (5) that we limit the use or disclosure of your sensitive personal information to purposes set forth in the statute, including that use which is necessary and anticipated to perform the services or provide the goods reasonably expected by an average consumer who requests those goods or services ("Right to Limit the Use and Disclosure of Sensitive Personal Information"), all subject to the meanings and exceptions set forth in the CCPA and CPRA. Verifying Requests
We will take reasonable steps to verify your identity based upon the information you provide and the type of request you are making. When you exercise your Right to Know, Right to Delete, and/or Right to Correct Inaccurate Information, we may ask that you provide us with information, beyond your full name, in order to verify your identity and fulfill your request. If you have only interacted with Freeosk through your Retailer Credentials, please provide the email address associated with your retail account.
If we are unable to verify that the individual submitting the request is the same individual about whom we have collected information (or someone authorized by that individual to act on their behalf), we will not be able to process the request.
Agents
If you are an authorized representative submitting a request on a consumer's behalf, please follow the instructions below for submitting a request and indicate you are an agent. You may also contact us at privacy@thefreeosk.com or call us at (888) 563-1121. We will also ask you to submit a declaration signed by the individual who is the subject of the request authorizing you to make the request on their behalf. The written permission must state your full legal name, the full legal name of the individual who is the subject of the request, and needs to be clear about the permission granted. Alternatively, you may submit a copy of a power of attorney under Probate Code sections 4000-4465. The consumer's identity, in addition to your own, will need to be independently verified in order for us to be able to fulfill your request. We may also ask the consumer to directly confirm with us that they provided you permission to submit a request. Please keep in mind that if we do not receive adequate proof of identity and that you are authorized to act on the consumer's behalf, we may deny the request.
Requests to Know
California Consumers have the right to know what information we have collected about you (the categories and the specific pieces of information). If you are a California consumer and would like to exercise your Right to Know, please submit your request at https://www.thefreeosk.com/InfoRequest or (888) 563-1121.
In order to have us provide specific pieces of information, we will require a signed declaration under penalty of perjury that you are the consumer whose Personal Information is the subject of the request.
Requests to Delete
California Consumers have the right to request that we delete information we have collected from you. If you are a California consumer and would like to exercise your Right to Delete, please submit your request via email to privacy@thefreeosk.com or call (888) 563-1121.
To ensure that we do not delete your personal data in response to a fraudulent request, once you submit the request to delete, we may follow up to confirm that you want your information to be deleted.
Right to Correct Inaccurate Information

Data Retention

California consumers have the right to not receive discriminatory treatment for exercising CCPA and CPRA rights. We will not discriminate against you for exercising your CCPA and CPRA rights.
Do Not Track
Some Internet browsers may be configured to incorporate a "Do Not Track" feature that, when turned on, signals to websites and online services that you do not wish to be tracked. Because there is no consensus among industry participants on an accepted standard for how to respond to browser "Do Not Track" signals, we do not currently respond to them. Notice of Financial Incentive
Under California regulations, certain programs we offer that provide benefits to consumers may be considered financial incentive programs. We may collect personal information from you in connection with these programs, e.g., such as contact information (name, email address, phone number) and certain commercial information (e.g., purchase history) for a number of reasons, including to administer the program, contact you with regard to your account (if any), to provide the benefits to you, to better serve you, and to fulfill your requests associated with the program.
